BIR Region 9 observes strict implementation of “OPLAN Kandado ”

Zamboanga City- Bogus business operators and tax cheaters beware!

The Bureau of Internal Revenue- Revenue District No. 15- (BIR Regional Office) is strictly implementing “Oplan Kandado,” an initiative involving the strengthening of the bureau’s imposition of prescribed administrative sanction for non-compliance with such essential requirements as: issuance of receipts, filing of returns, declaration of taxable transactions, tax payer registration, and paying the correct amount of taxes as mandated by the norms/standards of their particular industry or line of business.  

BIR 9 Regional Director Glen A. Herardino said “we have conducted surveillance of 60 establishments all over the region.”

“30 establishments here in Zamboanga City have already been monitored. May mga business operators na we have found guilty of non compliance of essential requirements and hopefully may ma padlock tayong store.” Director Herardino said.  

Mr. Herardino however refused to name names of establishments that are “candidates” for padlocking.  

Herardino said his office is very keen and careful on carrying the implementation of Oplan Kandado and make sure that all necessary warnings, evidences are properly laid before finally “padlocking” the business establishment.

“We have already conducted meeting with auditors of various business establishments and have appealed to them not to engage in any form of tax cheats. kasi yung establishment naman ng pinag tatrabahuhan nila ang mapapadlock” he added  

Director Herardino said that the surveillance activity came in response to Commisioner Sixto S. Esquivias IV order for concerned revenue offices to immediately conduct pre-audit of annual Income Tax Returns (ITR) filed by individual and corporate taxpayers for taxable year 2008 to check tax payers’ compliance with certain Income Tax regulations.

“Oplan Kandado” is being implemented nationwide.  It can be recalled, since January 2009 up to June 18, the BIR has already closed forty-two (42) business establishments all over the country, thirteen (13) of which were closed in June. These included three (3) establishments in the Boracay Island, namely: Salic Collection; BigMouth Express Specialist, Inc.; and Alice in Wonderland Resort, Bar and Restaurant. Salic Collection (a south sea pearls and fine jewelry shop) and Alice in Wonderland Resort, Bar and Restaurant were both closed for under declaring

their sales/revenues and for not filing the required VAT returns. BigMouth Express Specialist, Inc. (a popular restaurant), on the other hand, was found to be an unregistered enterprise and,  therefore, was not filing or paying internal revenue taxes. Its cash register machines were likewise unregistered with the BIR.  

In Davao City, five (5) establishments were padlocked last June 9 by RR 19 - Davao City officials, headed by OIC-Regional Director Perfecto L. Aranas, for violation of the Value-Added Tax (VAT) Law.

In Caloocan City, RDO No. 27 has padlocked a business establishment owned by Alfonso So (located at the Victory Central Mall) for non-registration of the business; non-issuance of sales invoices and receipts; and failure to file Percentage Tax and VAT returns.

Other establishments that were closed by the BIR in June are: Murray’s Wine - Burger Corp. in Taguig (on June 9); Raiko 10-28 Bar and Restaurant (also known as Ratsky on June 11) and Maintenance and Technologies Services Corp. (on June 17), both in Quezon City; Jolliza’s Mart and Rice Dealer in Calamba, Laguna (on June 18); and PizzaRapp Inc. (on June 18).
